		<description>Million Dollar Journey- you raise an often debated legal point as it pertains to liability arising out of the internet. Lawyers can &quot;forum shop&quot; and find a friendly court that would assume jurisdiction but the jurisdiction has to have sufficient nexus to the alleged wrong. Assuming the plaintiff won in a jurisdiction the defendant didn&#039;t reside, it would then have to go to the defendant&#039;s jurisdiction to enforce judgment. The local court can always reject the enforcement proceeding for policy reasons. So this strategy has some risks for the plaintiff.

As you suggested, the plaintiff could hire a local lawyer to commence proceedings but if the defendant resides in a &quot;defendant friendly jurisdiction&quot; (for example, the United States has a lot of defenses to libel given First Amendment rights), it may be self-defeating to the plaintiff. The other issue becomes if a plaintiff wants to sue in your backyard, does it actually have any presence in that jurisdiction? If not, what damage has it really suffered?

The issue isn&#039;t really clean-cut. Cross border litigation becomes a bit of a procedural mess which means the cost benefit of initiating a suit goes up.</description>

		<description>Great information - I often wondered about double taxation when people mentioned incorporating to reduce taxes. It makes sense that it helps the most when you plan to re-invest the profits (although if you did it soon enough it should be an expense instead of a profit).

I think there&#039;s really very few blogs that can gain a lot from incorporating; blogs are so easy to start that people sometimes overestimate how successful they&#039;ll be. Hopefully anyone considering incorporating for their blog doesn&#039;t do it too soon, and thinks about what level of success they should see before they know it&#039;s getting big.</description>

		<description>TMW, thanks for the great article and expertise.  I have a question, say an American company sued a Canadian blogger.  Would the company need a rep and come to Canada to sue personally?  Is it more difficult to sue across borders?</description>
